James Skelton

James is a member of Swaab Attorneys’ corporate, commercial and intellectual property practice with a focus on business advice, corporate and commercial transactions, commercialisation of intellectual property rights and brand protection strategies.

James was named the 2017 Australian Young Lawyer of the Year by the Law Council of Australia and won the 2017 Lawyers Weekly “30 Under 30” Award for commercial law in Australia. He was previously a finalist in the 2017 & 2016 Australian Law Awards for “Young Gun of the Year” and 2015 “30 Under 30” Awards.

Recently, James completed a secondment to the Liberal Party of Australia (NSW Division) in the role of Party Affairs Manager and General Counsel and was responsible for managing the organisation’s legal, membership and party affairs teams, reporting directly to the State Director and State Executive board.

Prior to joining Swaab, James worked at the Federal Court of Australia as a Registrars’ Associate in NSW and the ACT and also has experience with matters in the Federal Circuit Court, the Copyright Tribunal and hearings conducted before IP Australia.

James has a Juris Doctor and Bachelor of International Studies from UNSW, developing additional international business experience at the University of Bonn, Germany. James also has significant fashion and luxury retail knowledge from both a sales and retail operations perspective gained from over 7 years’ experience with an international luxury brand, providing a valuable commercial approach to his legal problem solving.

James was elected an Executive Councillor of NSW Young Lawyers in 2015 and has been appointed to Diversity and Inclusion Committee of the Law Society of NSW. James also sits on the board of prominent Sydney charity - The Aurora Group.

  • Negotiating, advising and conducting on IP infringement actions
  • Drafting IP licence and assignment documents including software licenses, database and data transfer agreements
  • Advising on brand protection strategies for domestic and multinational clients including managing trade mark portfolios
  • Drafting and advising on sponsorship agreements, confidentiality agreements, service agreements, terms of trade and other commercial agreements
  • Conducting all aspects of business sale transactions
  • Providing corporate secretarial assistance and advice
